TERMS & CONDITIONS

CONSUMER CUSTOMER

Article 1 – GENERAL PROVISIONS – SCOPE OF APPLICATION

1.1

These Terms and Conditions of Sale (“T&Cs”) define the rights and obligations of the parties in the context of the online sale of products offered by the company.

1.2

These T&Cs apply to any order placed by an adult individual acting as a consumer. The customer therefore certifies that they are a natural person over 18 years of age acting for purposes unrelated to any commercial, industrial, artisanal, professional, or agricultural activity. The customer acknowledges having full legal capacity to enter into commitments when placing an order and agrees to provide accurate information regarding their identity.

1.3 Exclusion

Persons acting in a professional capacity are expressly excluded from the scope of these T&Cs. This includes individuals or legal entities, public or private, acting for purposes related to their professional, industrial, artisanal, liberal, or agricultural activity, including when acting in the name or on behalf of another professional. Professionals wishing to place an order must contact the company directly.

The T&Cs applicable to each order are those in force on the date of payment (or first payment in the case of multiple payments). The company reserves the right to modify them at any time by publishing a new version on its website. These T&Cs are available on the company’s website.


Article 2 – ONLINE CONTRACT FORMATION

2.1 Order Process

To purchase one or more products on the website, the customer selects each product and adds it to the shopping cart. Once the selection is complete, the customer must confirm the cart to proceed with the order (first click).

At this stage, the customer is redirected to a page containing:

  • A summary of the selected products and their prices
  • The Terms and Conditions of Sale
  • Shipping fees

It is the customer’s responsibility to review and, if necessary, correct the contents of the cart. Confirming the order after reading the T&Cs (second click) constitutes acceptance of the contract and implies an obligation to pay.

The customer is then redirected to the payment page to choose a payment method and complete the transaction. After confirmation and payment, the customer receives a confirmation email containing:

  • The order summary (products, prices, T&Cs, shipping fees)
  • The order number

If this email is not received, the customer is invited to contact the company via the contact form on the website. Customers are strongly advised to keep this email and electronic invoice as proof of the contract.

2.2 Refusal of Order Validation

The company reserves the right to refuse any order for legitimate reasons, including but not limited to:

  • Orders not complying with these T&Cs
  • Abnormal quantities for a consumer
  • Non-payment or disputes relating to previous orders
  • Suspicion of fraud

2.3 Order Cancellation

Customers are advised to contact the company promptly for any cancellation request, but cancellation is not guaranteed. If the order has already been prepared or shipped, it must be returned at the customer’s expense in order to obtain a refund.


Article 3 – PRODUCT CHARACTERISTICS & AVAILABILITY

3.1 Product Characteristics

The essential characteristics of the products and their prices are available on the company’s website, along with usage information where applicable.

The company declines all responsibility for errors resulting from information provided by suppliers. Illustrations, videos, and photographs are non-contractual.

3.2 Product Availability

Offers are valid while supplier stock lasts. Availability is indicated on the product page. Adding a product to the cart does not guarantee availability. If a product becomes unavailable after order validation, the customer will be informed by email and the order will be canceled with a refund of the amounts paid.


Article 4 – PRODUCT PRICES

The displayed price is the price recommended by the brand, manufacturer, or official representative, or otherwise based on prices commonly charged within the distribution network. Prices may be updated at any time.


Article 5 – PAYMENT

5.1 Payment Timing

Full payment must be made immediately after order validation. Installment payments may exceptionally be granted upon request.

5.2 Payment Methods

  • Credit/Debit Cards (Visa, MasterCard, American Express, Maestro)
  • PayPal (limit €1,000)
  • Gift cards and promotional codes

Any unauthorized or refused payment may result in the suspension or cancellation of the order. The company may verify the customer’s identity and banking information before validating the order.


Article 6 – SHIPPING – CUSTOMS – RECEIPT

6.1 Shipping

Shipping fees are borne by the customer and included in the final price. Delivery times may vary in cases of force majeure, high demand, or holiday periods.

6.2 Customs Clearance

The customer is considered the importer of the products and is responsible for any applicable customs duties or taxes. The company is not responsible for customs fees.

6.3 Receipt

The customer must verify the integrity and completeness of the product upon receipt and report any issues within three days.


Article 7 – RIGHT OF WITHDRAWAL

7.1 Principle and Deadline

The customer has the right to withdraw within 14 days after receiving the product without providing any reason. Return shipping costs remain the responsibility of the customer.

7.2 Exclusions

The following products cannot be returned:

  • Personalized or perishable products
  • Products unsealed for hygiene or health reasons
  • Opened software, audio, or video recordings
  • Newspapers and magazines (except subscriptions)
  • Public auction sales

7.3 Procedure

The customer must inform the company of their withdrawal using the standard withdrawal form or a clear written statement. The customer then has 14 days to return the product in perfect condition and complete. Refunds will be processed within 14 days using the original payment method.


Article 8 – WARRANTIES

Certain products benefit from a supplier or manufacturer warranty. Unless otherwise specified, the standard warranty period is 1 year.


Article 9 – PERSONAL DATA PROTECTION

Personal data collected (name, address, etc.) is necessary for order processing and retained for 5 years. Customers have the right to access, rectify, oppose, and restrict the processing of their personal data.


Article 10 – INTELLECTUAL PROPERTY

Sales do not result in any transfer of intellectual property rights. Trademarks, domain names, products, software, images, and texts remain the exclusive property of the company or their respective authors.


Article 11 – FORCE MAJEURE

The company shall not be held liable in cases of force majeure preventing the fulfillment of its obligations.


Article 12 – DISCLAIMER OF LIABILITY

The company cannot be held responsible for damages resulting from improper use or unauthorized modifications of the products.


Article 13 – ACCOUNT SUSPENSION OR TERMINATION

The company may suspend or terminate the account of any customer violating these T&Cs. A closed account may not be recreated without authorization.


Article 14 – INVALIDITY & MODIFICATION

If any clause is deemed invalid, it shall be considered unwritten without affecting the validity of the remaining provisions. Any tolerance by the company shall not constitute a modification of these T&Cs.


Article 15 – APPLICABLE LAW & DISPUTE RESOLUTION

These T&Cs are governed by U.S. law. In the event of a dispute, customer service remains available to seek an amicable solution. Customers may also use the European Commission’s Online Dispute Resolution platform:
